Minton's first legal opinions pass the AMAC review
In July 2016 two legal opinions issued by Minton Law Firm for two large private funds, on the registration and filing of their managers, passed the review of the Asset Management Association of China in succession — one after a single round of feedback, the other without any. The opinions rested on full due diligence and on the Association's rules, and led the managers to standardise their operations and adopt risk management and internal control systems. The result recognises both the substance of the opinions and the care taken in preparing them; Han Yu and Liu Yanmei each acted throughout for one of the two managers.
In July 2016 two legal opinions issued by Minton Law Firm for two large private funds, on the registration and filing of their private fund managers, passed the review of the Asset Management Association of China (the "Association") in succession. One of them passed after one round of feedback to the Association, the other passed directly without any.
In those two opinions Minton's lawyers, following the rules and requirements of the Association and keeping abreast of the gist of the speeches of those in charge of it at its meetings, took account of the particular position of each private fund institution and, on the basis of full due diligence, proposed to it how to standardise its operations and management and helped it put in place standard risk management and internal control systems. In the end the legal opinions of the institutions passed the Association's review smoothly. This represents not only the Association's acceptance of the substance of the legal opinions Minton issued but also a recognition of the careful and rigorous work of the firm's lawyers in the earlier stages.
