On 16 March Shen Mo, director of Shanghai Minton Law Firm, and senior partner Yao Yuwei together took part in an exchange held in Shanghai by the Australian Chamber of Commerce. The Minton lawyers gave a talk on the protection of trade secrets, in which they focused on the scope of a trade secret and shared sensible experience of corporate risk control.

The event was held at Rio Tinto, a company which is understood to have entered the Chinese market early and to be a world leader in the exploration, extraction and processing of mineral resources. At the event senior management of Rio Tinto introduced the company's operations and strategy. The Minton lawyers gave their talk and, with the other participants, toured the group's offices. Most of those present were managers of manufacturing and supply businesses.

The Minton lawyers Shen Mo and Yao Yuwei gave a talk on the protection of trade secrets, focusing on the scope of a trade secret and offering sensible experience of corporate risk control. As is well known, trade secrets are closely bound up with daily life; the groups to be addressed fall into three categories, suppliers, customers and employees, and different internal supervisory systems should be devised according to the business a company carries on. The Minton lawyers also used slides to introduce the firm's expertise to an international audience, explaining it with reference to cases from practice. At the same time they answered the legal questions of the company executives present.

At the close of the event the Minton lawyers also introduced free templates for legal documents on trade secrets, and offered professional legal consultation.

It is worth noting that, because trade secrets are so frequently used, preventing their disclosure altogether is extremely difficult. All that can be done is to reduce the likelihood of disclosure as far as possible, and to raise the cost to the infringer of breaking the law to the greatest extent. Large foreign trade companies are of great market value in China, and it is particularly important to strengthen the bargaining power of Chinese manufacturers and the technological standards of Chinese manufacturing; protecting the trade secrets of foreign trade enterprises, and China's commercial rules, is a duty Minton will not shirk.
